Trademark Infringement?

I don’t know the answer to that. I’ve been hit with attorney letters from a vendor in GA that didn’t like my review of his product he sent me to review, an org that was ticked with me. Why people get so bent out of shape with a water spraying redneck from the Tarheel state is beyond me.

No comprende softwash around here either.
I usually end up saying “low pressure high volume pumps with soap” and that does the trick.

@Clean_Blue - Just did a search on the US Patent and Trademark office, and it looks like he does in fact own the mark ( TESS -- Error)

With all of that said it seems like he filed the trademark for “SoftWash Systems” - From the demand letter you attached it’s unclear whether he’s trying to claim he has a trademark on “SoftWash”, “SoftWash Systems” of both variations. To me it sounds like the business is using “SoftWash” in it’s description of services (not the trademarked “SoftWash Systems”) and AC is claiming that the similar use of the capital S and W in Softwash (along with it being one word) could create confusion amongst consumers that the business is associated with SoftWash Systems.

If I had to argue this in court AKA the worst case of all time, I’d argue that the use of capitalizing S and W in the word SoftWash, and using that one word exclusively, as opposed to SoftWash Services, would not create confusion amongst consumers that the business is associated with SoftWash Systems. I’d go on to say that the recommendation from the trademark owner that inserting a hyphen would differentiate our logos, really doesn’t hold water, since a hyphenated word is still one word (one of AC’s arguments) and the S and W would still be capitalized.

This whole thing is pretty goofy to me, and what looks like a total waste of time, but he went the extra mile to trademark “SoftWash Systems” - so i guess if he wants to spend his days combing through the internet and phonebook looking for powerwashing businesses who use “SoftWash” in their titles and then type up a demand letter, more power to him. From real life practical point of view… i’d just hyphenate it or uncapitalize one of the letters since it’s abundantly clear he’s keeping tabs on people who spell “SoftWash” that way.

The proper way to spell the company is
SnakeWash . It’s short for snake oil . Milinails like to abbreviate stuff and his market is knewbies that don’t know better yet

I first heard of him about 10 years ago. it didn’t take much to form the opinion that the videos I watched were time that I would never get back.

Jeepers, that guy is BORING!

His systems have helped a lot of people over the years, some of them are still with him and obviously see good value in it. His truck mounted systems are some of the best out there. Ask @Diamond_Soft_Wash what he thinks.

I would rather not comment on AC. If I wanted to tell a story about it I would of.

@SchertzServicesLLC, I have a 3 year old and a 10 month old who doesn’t sleep. I would thoroughly welcome a safe space and therapist at this point in my life. Lol.

Like @Racer said, I also have no problem with A.C. I know a lot of people want to buy a “business in a box” where everything is color coded and the guesswork is taken out. A.C. figured out how to capitalize on that and if he had the good sense to copywrite a name, then too bad, so sad, that’s his right. I think he turns out nice looking trucks and equipment.
