@Clean_Blue - Just did a search on the US Patent and Trademark office, and it looks like he does in fact own the mark ( TESS -- Error)
With all of that said it seems like he filed the trademark for âSoftWash Systemsâ - From the demand letter you attached itâs unclear whether heâs trying to claim he has a trademark on âSoftWashâ, âSoftWash Systemsâ of both variations. To me it sounds like the business is using âSoftWashâ in itâs description of services (not the trademarked âSoftWash Systemsâ) and AC is claiming that the similar use of the capital S and W in Softwash (along with it being one word) could create confusion amongst consumers that the business is associated with SoftWash Systems.
If I had to argue this in court AKA the worst case of all time, Iâd argue that the use of capitalizing S and W in the word SoftWash, and using that one word exclusively, as opposed to SoftWash Services, would not create confusion amongst consumers that the business is associated with SoftWash Systems. Iâd go on to say that the recommendation from the trademark owner that inserting a hyphen would differentiate our logos, really doesnât hold water, since a hyphenated word is still one word (one of ACâs arguments) and the S and W would still be capitalized.
This whole thing is pretty goofy to me, and what looks like a total waste of time, but he went the extra mile to trademark âSoftWash Systemsâ - so i guess if he wants to spend his days combing through the internet and phonebook looking for powerwashing businesses who use âSoftWashâ in their titles and then type up a demand letter, more power to him. From real life practical point of view⌠iâd just hyphenate it or uncapitalize one of the letters since itâs abundantly clear heâs keeping tabs on people who spell âSoftWashâ that way.

I first heard of him about 10 years ago. it didnât take much to form the opinion that the videos I watched were time that I would never get back.
Jeepers, that guy is BORING!
His systems have helped a lot of people over the years, some of them are still with him and obviously see good value in it. His truck mounted systems are some of the best out there. Ask @Diamond_Soft_Wash what he thinks.

Like @Racer said, I also have no problem with A.C. I know a lot of people want to buy a âbusiness in a boxâ where everything is color coded and the guesswork is taken out. A.C. figured out how to capitalize on that and if he had the good sense to copywrite a name, then too bad, so sad, thatâs his right. I think he turns out nice looking trucks and equipment.
