It’s actually really easy guidelines…is the other person operate as their entity, or does all of their income come from you? Do they drive their own vehicle and use all their own equipment.

1099 is for when a power washing company needs to hire a painting company to come stain some decks.

Not for Bill who wants Jim to use all of his equipment and look/act like an employee but doesn’t want to pay the workmen’s comp or payroll taxes.

Well, technically there are 7 or 8 factors that determine if a person is an employee or contractor according to the IRS. No where do they specify how many flip it from one to the other. Also state laws vary. On a practical level I think you are 100% correct.
