(Edit: I was writing about charging him for damages. Yes, you should be able to fire them for incompetence.)

Ah really? Little different here in Canada I guess.
In that case - absolutely fire. If someone is blatantly ignoring protocol. 1st time, even 2nd time I get it but anything after that is just over the top.

He recently moved onto a union job. He was excellent at cleaning he just not a good listener.

Is that illegal? My old employer used to do that all the time.
An employer cannot charge employees for damages, missing monies or mistakes.

You can if it’s in their hiring paperwork if you dont have the clause put it in the contract along with your non compete clause
That depends on what state you are in. Fortunately, I’m in a right to work state and can for for any reason I want to basically. On the flip side, no compete contacts are not enforcible. I’ve never charged guys for losing turbo nozzles, frying elevators, etc. But, I’ve fired for being 2 minutes late for work or short tail untucked.

Non compete clause are like putting locks on your trailer. It’s a great idea that works most of the time.

I’d never make anyone sign one anyway. I’ve created 4 different business owners so far.

Varies from State to State. In many they are completely unenforceable.
The non compete got overturned in Canada, small populations they said it would affect too many people from securing work. Taking client names and contacting them is a serious issue though that the courts are not fond of.
Start to look at the leaves before you even start your machines. Most already have burn spots in them. Which would appear like they got a light ds mist on them. Also have the customer take note before time. It will save any headache. There are tons of them here.
